LABP Notice of Rulemaking Activity re Compounding for Office Use for Veterinarians

The following Notice of Rulemaking Activity has been released by the Louisiana Board of Pharmacy:


Compounding for Office Use for Veterinarians
Proposed Revision of Original Notice of Intent

Following the publication last summer of the original proposed rule allowing pharmacists to compound veterinary preparations for office use for veterinarians, the Board convened a public hearing to receive comments and testimony on that proposal.  During the Board's consideration of those comments this past fall, they requested the development of a revision to the proposed rule that would alert pharmacists to an apparent conflict between federal and state laws and rules on this topic, and further, that while the Board's rules would allow the practice to a limited degree, the Board's rule cannot provide immunity from any federal enforcement action.  The Board approved that revised language during their meeting on February 24, 2016, and further, directed the completion of the rulemaking process, and further, directed the cancellation of the original emergency rule and the adoption of the revised proposed rule as a revised Emergency Rule with an immediate effective date.  Copies of the revised Declaration of Emergency and revised Emergency Rule are availabe on the Board's website. 

The Board will publish the required Potpourri Notice in the March 20, 2016 edition of the Louisiana Register advertising this proposed revision of the original proposed rule.  That notice will advise interested parties of the April 19, 2016 public hearing to receive comments and testimony on the proposed revision to the original proposed rule.
