Notice of Rulemaking Activity

 

Final Rules & Cancellation of Emergency Rules

 

Regulatory Project 2016-4 ~ Standing Orders for Distribution of Naloxone

As authorized and directed by Act 370 of the 2016 Legislature, the Board published a Notice of Intent in the January 20, 2017 edition of the Louisiana Register to add a new section of rules to authorize pharmacists to distribute naloxone pursuant to a standing order.  The Board conducted a public hearing on March 1 to receive comments and testimony on the proposed new rule.  With no comments or testimony received, the Board submitted the required report to the legislative oversight committee on March 27.  With no further inquiry from the legislature, the Board published the Final Rule in the May 20, 2017 edition of the Louisiana Register.  The Final Rule became effective on the date of publication.  With the publication of the Final Rule, the previously-issued emergency rule was cancelled. The emergency rule has been removed from the Board's website, and further, the separate link for Chapter 25 - Prescriptions, Drugs, & Devices on the Laws & Rules page of the Board's website has been updated to include the new §2541 - Standing Orders for Distribution of Naloxone and Other Opioid Antagonists.

 

Regulatory Project 2016-5 ~ Reinstatement of CDS Licenses

The Board published a Notice of Intent in the January 20, 2017 edition of the Louisiana Register to amend §2707 of its rules relative to the reinstatement process for CDS licenses for those medical practitioners whose primary professional licenses have been disciplined by their primary licensing agency.  The Board conducted a public hearing on March 1 to receive comments and testimony on the proposed rule amendment.  With no comments or testimony received, the Board submitted the required report to the legislative oversight committee on March 27.  With no further inquiry from the legislature, the Board published the Final Rule in the May 20, 2017 edition of the Louisiana Register.  The Final Rule became effective on the date of publication.  With the publication of the Final Rule, the previously-issued emergency rule was cancelled.  The emergency rule has been removed from the Board's website, and further, the separate link for Chapter 27 - Controlled Dangerous Substances on the Laws & Rules page of the Board's website has been updated to include the amendment of §2707.C.4.
